Mumbai vs. Bangalore Lawsuit

Aug 02, 2010 — BANGALORE, INDIA (SUN) — The following report was received from our correspondent in Bangalore, regarding the ongoing lawsuit between ISKCON Mumbai and ISKCON Bangalore.

Apparently the Madhu Pandit dasa versus ISKCON Mumbai appeals case is now in its 2nd week. My sources tell me that the judge has understood the case. The judge is supposed to be smart and "clean," we shall see. India's judicial system is notoriously corrupt as they scraped the jury system and depend only on easily managed judges. But since this is the High Court of Karnataka, they are supposed to be better.

Anyway, ISKCON Mumbai winds up its arguments in the next day or two, then Madhu Pandit's lawyers will give their side. Then ISKCON Mumbai will rebut, and then the judge will give his judgment. So listening to the case will take about 2-3 weeks more before the decision is handed down. There is no fixed date for when the judgement will be given; there will likely only be a day's notice given.

My sources say that neither Madhu Pandit dasa or Chancalapati dasa ever come to the court , only Jaichaitanya. They say that Madhu Pandit's lawyers are not happy, but who knows how much can be read into that. They said the same thing in the lower court, but the judge kept delaying the judgment we are told, till the price was right, then he gave his judgement. In these things it is hard to prove bribery.

There is also another case colloquially called the Amyavilasa case, though Amyavilasa Svami actually defected to Madhu Pandit dasa last year. We heard that the Svami wants to return to ISKCON Mumbai, but that they are not interested in such a fickle person. Anyway, that case was supposed to start this week but the judge, being a new appointee, recused himself from such a controversial case. They are waiting for the Chief Justice to appoint a new judge.

I also heard that the criminal contempt case against Madhu Pandit dasa has been given to a notorious lady judge known to be dirty. It is suspected that even though the High Court itself initiated proceedings against Madhu Pandit dasa, that it will now drop the matter. This is typical of the rotten Indian courts.

What has transpired here could never have happened in Western Europe or North America. It is that corrupt.

Anyway, it should not be too long till the High Court of Karnataka makes its decision. But whoever wins, it is expected that it will be pushed up to the Supreme Court.
